ROCO TERMS AND CONDITIONS
These terms apply to the ROCO Entertainment services identified in your accepted proposal or service agreement. Your event-specific pricing, scope, schedule, payment schedule and any expressly agreed exceptions remain in that document. Venue, equipment, power and weatherproof-space requirements apply to the booked services and setup confirmed with ROCO. Any person, persons, or organization paying a security deposit agrees to the terms and conditions on this page.
- Upon execution of this contract, ROCO ENTERTAINMENT reserves the time and date agreed upon, and will not make other reservations for the contracted time and date. For this reason, all deposits are non-refundable. At our option, and only if cancellation is made with sufficient advance notice for us to re-schedule the date which was reserved, we will re-book that date and time and may issue a partial refund of your deposit upon re-booking. There will be a $100.00 cancellation fee that will be charged or withheld from the deposit.
- If ROCO ENTERTAINMENT cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, then ROCO ENTERTAINMENT shall return the deposit to the client but shall have no further liability with respect to the agreement. In the event that ROCO ENTERTAINMENT fails to perform for any other reason, in whole or in part, it shall not be liable for any amount in excess of the amount actually paid by Client under this contract.
- ROCO ENTERTAINMENT provides no guarantees or warranties in conjunction with its services. The parties specifically agree that the damages for non-performance of this proposal are uncertain, speculative and difficult of ascertainment. The parties, as a reasonable mode of determining damages, agree that the maximum amount of damages available for a breach of any of ROCO ENTERTAINMENT’S obligations to the client shall be the amount actually paid by Client under this contract.
- Any Alteration from above involving extra costs will be executed only upon written orders, and will become an extra charge above this estimate.
- Client is responsible for providing a safe venue for ROCO ENTERTAINMENT to provide services. Client shall be responsible for any damage caused to the equipment of ROCO ENTERTAINMENT by any guests, persons or conditions present at the event. Client agrees to pay reasonable repair or cleaning costs in the event it is determined neccesary.
- Client agrees to provide a completely weatherproof area of at least 10’ x 10’ for ROCO ENTERTAINMENT’S equipment and a reliable three-prong power outlet source. If Client fails to provide a set up location which ROCO ENTERTAINMENT deems adequate, the company shall have the right to refuse to perform and Client shall forfeit all deposit and be required to pay all sums due and owing under this contract.
- Any additional time requested by the client will be for $200 an hour and only if our staff is available.
- All payments must be received the day before the event.
- The Client grants Roco Entertainment permission to use any photographs, video recordings, or media featuring the event participants for promotional purposes. The Client releases the contractor from any liability associated with such use. No compensation will be provided, and consent revocation must be in writing.
